Current State of Eviction Moratoriums

Landlords and Tenants in Illinois must now look to our State government and the Illinois Supreme Court for guidance with regards to current eviction procedure and moratoriums. Why? The short answer:   On August 3, 2021, the CDC (U.S. Center for Disease Control and Prevention) issued an Order temporary halting all residential evictions in communities throughout the United States with substantial or high levels of community transmission of COVID-19. The Order was to be affective from August 3, 2021 through October 3, 2021. However, on Thursday, August 26, 2021, the U.S. Supreme Court voted 6-3 to overturn this CDC Order, ruling that the CDC exceeded its authority with the temporary ban.

Until this past Monday, in Illinois, there was a temporary stay on evictions through September 1, 2021. However, this Monday, August 30, 2021, the Illinois Supreme Court amended its previous Order, extending said temporary stay through September 18, 2021.
